These Terms of Service (“Terms”) govern your access to and use of https://structuralseo.com (the “Website”), operated by Structural SEO (ABN 59 345 408 903) (“Structural SEO”, “we”, “us” or “our”).
By accessing or using the Website, you agree to these Terms and to our Privacy Policy, which forms part of these Terms. If you do not agree, please do not use the Website.
1. Scope of these Terms
These Terms apply to your use of the Website. Any SEO, consulting or related services we provide are governed by a separate written proposal, statement of work or services agreement. If there is any inconsistency between these Terms and that agreement, the agreement prevails.
2. Using the Website
You may use the Website for lawful purposes only. You must not:
- use the Website in any way that breaches any applicable law or infringes anyone’s rights
- attempt to gain unauthorised access to the Website, its servers or any connected systems
- introduce viruses, malicious code or anything that could damage or disrupt the Website
- use automated tools to overload, attack or interfere with the normal operation of the Website
- submit false, misleading, offensive or spam content through our contact form or booking tools
- reproduce, republish or sell substantial parts of the Website’s content without our written permission
Quoting short extracts of our content with clear attribution and a link back to the original page is welcome.
3. Analytics, cookies, tracking and advertising
By using the Website, you acknowledge and agree that we and our third-party partners may use cookies, pixels, tags, scripts, session-recording and similar technologies to collect information about your device and how you use the Website. We use this information to:
- measure traffic, engagement and conversions, including with Google Analytics and Cloudflare Web Analytics
- understand how visitors interact with our pages through behavioural metrics, heatmaps and session replay, including with Microsoft Clarity
- show you advertising on other websites, apps and platforms, including remarketing to people who have visited the Website, and measure how well that advertising performs, using platforms such as Google Ads, Microsoft Advertising, Meta (Facebook and Instagram) and LinkedIn
- protect the Website and our contact form from spam, fraud and abuse, including with Cloudflare Turnstile
Our Privacy Policy explains what information these technologies collect, who receives it and how you can opt out. You can block or delete cookies through your browser settings and control personalised advertising through each platform’s ad settings. If you block cookies, some parts of the Website, such as the contact form’s spam check, may not work properly.
Where the law in your location requires your consent before non-essential cookies are used, we will ask for it, and you can withdraw your consent at any time.
4. Enquiries and communications
When you submit our contact form, book a call or otherwise contact us, you confirm that the information you provide is accurate and that you are authorised to provide it. You consent to us contacting you by email or phone about your enquiry.
We will only send you marketing messages in accordance with the Spam Act 2003 (Cth), and every marketing email will include a way to unsubscribe.
5. Information on the Website and results
Content on the Website is general information only. It is not professional advice tailored to your business, and you should not rely on it as a substitute for that advice.
Search engine optimisation results depend on many factors outside our control, including search engine algorithms, competition, market conditions and the condition of your website. Case studies, results, figures and testimonials on the Website describe outcomes achieved for specific clients in specific circumstances. They are not a promise or guarantee that you will achieve similar results.
Any prices or price ranges shown on the Website, including in our FAQs, are indicative only and do not constitute an offer. Pricing becomes binding only when set out in a written proposal or agreement that we both accept.
6. Intellectual property
The Website and its content, including text, graphics, images, videos, logos, design and code, are owned by or licensed to Structural SEO and are protected by copyright and other intellectual property laws.
Client names and logos shown on the Website are the trademarks of their respective owners and are displayed with permission. Nothing on the Website grants you a licence to use them.
You may view the Website, print or save pages for your own reference, and share links to our pages. Any other use requires our prior written permission.
7. Third-party links and embedded content
The Website contains links to third-party websites and embedded content from third parties such as YouTube and Calendly. We do not control those services and are not responsible for their content, availability or privacy practices. Your use of them is governed by their own terms and policies.
8. Availability of the Website
We may update, change, suspend or discontinue any part of the Website at any time without notice. We do not guarantee that the Website will be available at all times, uninterrupted, secure or free of errors.
9. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other legislation that cannot lawfully be excluded or limited.
Where our liability for a breach of a non-excludable guarantee can be limited, our liability is limited, at our option, to supplying the services again or paying the cost of having the services supplied again.
10. Limitation of liability
To the maximum extent permitted by law:
- the Website and its content are provided “as is” and “as available”, and we exclude all warranties, representations and conditions not expressly set out in these Terms
- we are not liable for any indirect, incidental, special or consequential loss or damage, or for any loss of profits, revenue, data, business or goodwill, arising out of or in connection with your use of, or reliance on, the Website
11. Indemnity
You agree to indemnify Structural SEO against any claims, losses, damages and costs (including reasonable legal costs) arising from your breach of these Terms or your unlawful use of the Website.
12. Changes to these Terms
We may update these Terms from time to time by publishing a new version on this page. The updated Terms take effect from the date shown at the top of the page. Your continued use of the Website after that date means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts that may hear appeals from them.
